The Second Civil Chamber of the Ticino Court of Appeal examined a tenant’s appeal against an eviction order issued by the Locarno-Città Pretura. The appeal, sent by fax and consisting only of the statement that the appellant was filing an appeal, lacked reasons and was also lodged after the 10-day deadline. The court therefore rejected it at the preliminary admissibility stage and ordered that no fees or costs be collected.
Art. 309 cpv. 2 lett. f, cpv. 5 CPC; art. 411 cpv. 2 CPC; art. 313bis CPC; admissibility of appeal. An appeal that is filed by fax, lacks any statement of reasons, and is in any event filed after expiry of the statutory appeal period is manifestly inadmissible and may be rejected at the preliminary examination stage. The three formal defects are each independently sufficient to bar entry into the merits; where such defects are apparent from the file, the appellate court may sanction the remedy without further inquiry.

con la quale l'istante ha chiesto lo sfratto della convenuta dall'appartamento di 1 1/2 locali al 1° piano (interno 5) nello stabile "__________" in via __________ a __________ che il pretore, con decreto 2 luglio 2002, ha integralmente accolto.
Appellante la convenuta la quale con scritto 22 luglio 2002 indirizzato, per fax, alla Pretura afferma, richiamandosi al decreto di sfratto, "Io faccio una ricorso".

Considerato
in fatto ed in diritto
che il ricorso all'esame è irricevibile per tre motivi:
perché trasmesso via fax (Cocchi/Trezzini, CPC-TI, ad art. 114 m. 1);
perché mancante di qualsiasi motivazione (art. 309 cpv. 2 litt. f e 309 cpv. 5 CPC; Cocchi/Trezzini, CPC-TI, ad art. 309 m. 16);
perché, in ogni caso, tardivo, essendo stato formulato dopo la decorrenza del termine di ricorso di 10 giorni (Cocchi/Trezzini, CPC-TI, ad art. 508 m. 7; art. 411 cpv. 2 CPC) dall'intimazione della sentenza;
che come tale va quindi sanzionato già all'esame preliminare dell'art. 313bis CPC;
Per i quali motivi
pronuncia
Il ricorso 22 luglio 2002 di __________ è irricevibile.
Non si prelevano tasse o spese.
