The appellant filed a supervisory complaint in debt enforcement proceedings before the Ticino Court of Appeal's Debt Enforcement and Bankruptcy Chamber. At the hearing of 18 November 2002, the appellant withdrew the complaint. The court therefore held that the appeal had become moot and struck it from the docket. It further held that the procedure was gratuitous and that no indemnity was due, so no costs were charged and no compensation was awarded. The decision also notes the possibility of further appeal to the Federal Supreme Court within ten days under the Enforcement and Bankruptcy Act.
Art. 17 LEF, art. 20a cpv. 1 LEF, art. 61 cpv. 2 lett. a e art. 62 cpv. 2 OTLEF; withdrawal of a supervisory complaint in debt enforcement renders the proceeding moot and justifies striking it off the roll. In such proceedings, the legislatively codified gratuitousness excludes court costs, and no indemnity is awarded. The court may accordingly limit itself to formal striking-out without further adjudication on the merits (consid. 1-2).

richiamata l’udienza 18 novembre 2002 nel corso della quale la ricorrente ha dichiarato di ritirare il proprio ricorso;
considerato che il gravame è diventato privo d’oggetto e va stralciato dai ruoli;
che sulle tasse occorre ricordare che – benché la gratuità della procedura sia contraria al sistema di diritto amministrativo in cui si muove il ricorso secondo l’art. 17 LEF (cfr. Jean-François Poudret/ Suzette Sandoz-Monod, Commentaire de la loi fédérale d’organisation judiciaire, vol. II, Berna 1990, n. 2.10 all’art. 81, p. 804) – siffatto principio è stato codificato per espressa volontà del legislatore (art. 20a cpv. 1 primo periodo LEF e 61 cpv. 2 lett. a OTLEF; DTF 125 III 383 cons. 2a); che per lo stesso motivo non si assegnano indennità (art. 62 cpv. 2 OTLEF);
visti gli art. 17 e 20a LEF, art. 61 seg. OTLEF;
pronuncia:
Il ricorso 11 settembre 2002 __________, è stralciato dai ruoli.
Non si prelevano spese e non si assegnano indennità.
Contro questa sentenza è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale, Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale d’appello, Lugano, in conformità dell’art. 19 LEF.
