The Ticino civil cassation chamber noted that the appellant withdrew the cassation complaint on 21 March 1995 because the dispute had been settled by agreement dated 17/21 March 1995. The court therefore struck the appeal from the rolls. It further recorded that the settlement also governed the allocation of costs and compensation, ordering the CHF 200 court costs, already advanced by the appellant, to be borne half by the appellant and the balance jointly by the respondents, with mutual compensation of ripetibili.

la sentenza 23 febbraio 1994 del Pretore della giurisdizione di Mendrisio nord nella causa procedura ordinaria inappellabile dipendente da istanza 28 ottobre 1991 promossa nei confronti di
e
rappr. dall’__________ (entrambi patrocinati dall’avv. __________)
con la quale si chiedeva la condanna dei convenuti al pagamento in via solidale di fr. 3’048.- oltre accessori, domanda accolta dal primo giudice limitatamente all’importo di fr. 762.-;
preso atto che la ricorrente, in data 21 marzo 1995, ha ritirato il gravame per intervenuta transazione sul merito della vertenza (convenzione 17/21 marzo 1995);
preso atto altresì che la transazione regola anche il carico delle spese di questa istanza e l’attribuzione delle ripetibili;
decreta:
Il ricorso per cassazione 16 marzo 1994 di __________ è stralciato dai ruoli.
Le spese processuali, per complessivi fr. 200.- già anticipati dalla ricorrente, rimangono a suo carico per la metà mentre la rimanenza è dovuta in solido da __________ e dalla __________.
Compensate le ripetibili di questa sede.
