The Ticino Administrative Court dealt with an appeal against a 4 November 1997 decision of the Expropriation Court of the Sottoceneri district. On 27 February 1998, the appellants' counsel informed the court that the appeal was withdrawn. The court held that the proceedings were therefore concluded, struck the appeal from the docket, and decided that no court fees or costs would be charged.
Withdrawal of appeal; termination of proceedings and no costs. Where the appellant withdraws the appeal, the appellate proceedings become moot and are struck from the docket. In such circumstances, and absent special reasons, the court may waive both court fees and costs (consid. 1-2).
