The Ticino Administrative Court dealt with appeals against a State Council decision concerning a parish tax for 1989/90. After the parish informed the court that it was withdrawing its appeals because of intervening legislative amendments, the court struck the case from the docket. It further ordered that no court fees or costs be levied.
Art. 3, 18, 28, 31, 60 and 61 PAmm; withdrawal of the appeal: where the appellant expressly withdraws the administrative appeal, the proceedings are to be struck out of the docket. In such a procedural termination, the court may order that no fees or expenses be charged, particularly when the withdrawal renders further adjudication unnecessary (consid. 1-2).
