The Ticino Administrative Court dealt with an appeal against the State Council's decision declaring inadmissible an earlier challenge to a municipal building permit for a wooden wall. la decisione 18 settembre 1996, no. 4787, del Consiglio di Stato, che dichiara irricevibile il ricorso 19 giugno 1996 del signor __________ interposto contro la decisione 4/6 giugno 1996 del municipio di __________, con la quale è stata rilasciata al signor __________, la licenza edilizia per la formazione di una parete in legno sul mapp. no. __________ RFD __________, in zona estensiva;
preso atto che in occasione dell’udienza di sopralluogo, dopo discussione, il ricorrente ha dichiarato di ritirare il ricorso a condizione che il resistente rinunci alle ripetibili di I e II istanza;
ritenuto che il resistente si è dichiarato d'accordo alla suddetta condizione;
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
