The Ticino Administrative Court dealt with an appeal against a State Council building-law decision. On 22 May 1996 the judge-rapporteur proposed a settlement: the appellants would withdraw the appeal and waive the awarded party costs, while the municipality would not enforce the rectification ordered by the State Council. Both sides accepted. The court therefore held that the proceedings were concluded, struck the appeal from the roll, and ordered that no court fees or expenses be collected.
Settlement in administrative appeal proceedings; where the parties accept a settlement proposal covering both the withdrawal of the appeal and the opposing party's waiver of enforcement, the court may consider the proceedings exhausted and strike the case from the roll. "1. i ricorrenti __________ ritirano il ricorso e rinunciano alle ripetibili assegnate loro dal Consiglio di Stato;
rilevato che, sia i ricorrenti, sia il municipio di __________ hanno aderito alla proposta transattiva;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
