The appellant withdrew its administrative appeal against the consortium’s decision awarding channel-cleaning works. The Ticino Administrative Court therefore struck the case from the roll and held the proceedings exhausted. No court fees or expenses were levied. Because the respondent had been represented by licensed counsel and filed a response, the court ordered the appellant to pay CHF 500 in party compensation (ripetibili) to the respondent.

la decisione 15 novembre 2001 del Consorzio depurazione Acque di Locarno e dintorni che delibera alla ditta __________ le opere di pulizia delle canalizzazioni;
preso atto che l'11 gennaio 2002 il patrocinatore della ricorrente ha comunicato di ritirare il ricorso;
ritenuto che il resistente si è avvalso di un legale iscritto all'albo per presentare l'allegato di risposta, per cui si giustifica la corresponsione di un'indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
La ricorrente rifonderà al Consorzio resistente l'importo di fr. 500.-- a titolo di indennità per ripetibili.
