The Tax Chamber of the Court of Appeal in Lugano noted that the taxpayer withdrew the appeal by letter of 1997-02-25. Since the appeal had therefore become moot, the court struck it from the docket. It also ordered that no court costs or justice fee be collected.
Withdrawal of an appeal; mootness; costs: where the appellant withdraws the tax appeal, the proceedings become devoid of object and the appeal is struck off the docket. In such a situation, and absent contrary circumstances, the court may waive the levying of court costs and justice fees (consid. implied).
