The taxpayer appealed in a real estate capital gains tax matter. Before the tribunal decided the merits, the appellant withdrew the appeal by letter of 7 June 2000. The Cantonal Tax Chamber held that the appeal had become moot and ordered the case struck from the docket. It also decided that no court costs or justice fee would be levied.
Arts. 207 cpv. 2 and 228 LT; arts. 134 cpv. 2 and 142 cpv. 4 LIFD: withdrawal of the appeal renders the proceedings devoid of object; the appeal is therefore struck from the docket. In such circumstances, the court may order that no costs or justice fee be collected.
