In a tax case concerning a request for security for cantonal and communal taxes for 1998/1999, the appellant withdrew the appeal by letter of 24 March 2000. The Tax Chamber of the Court of Appeal held that the appeal had become devoid of object and ordered it struck from the docket. It further decided that no court costs and no justice fee would be charged.
Withdrawal of an appeal renders the proceedings moot; the appellate court strikes the case from the docket. Where the appeal becomes devoid of object before judgment, the court may terminate the proceedings without costs, if the applicable tax procedural rules and the referred provisions so allow (Art. 207 cpv. 2 and 228 LT; Art. 134 cpv. 2 and 142 cpv. 4 LIFD).
