The appellant challenged the Cantonal Government’s approval of a municipal zoning plan. Before the court decided, the appellant’s representative withdrew the appeal by letter of 27 September 1996. The Tribunal held that the matter had become moot, struck the case from the docket, and ordered that no court fees or costs be collected.
Appeal withdrawn; mootness and costs: when the appellant expressly withdraws the appeal, the proceedings are struck off the roll for lack of object. In such a situation, the court may order that no fees or costs be taken, absent circumstances warranting a different allocation.
