The appellant challenged a 12 March 1997 State Council resolution approving variants of the zoning plan of the municipality. By letter of 9 July 1997, counsel for the appellant withdrew the appeal. The Tribunal of Territorial Planning therefore held that the case had become moot, struck the appeal from the docket, and ordered that no fees or costs be levied.
Withdrawal of the appeal renders the proceedings moot; the court strikes the case from the docket and may waive court fees and costs. In such a situation, no substantive review of the challenged planning decision is carried out.
