RI 1 appealed the State Council’s approval of the zoning plan of the former municipality of Fusio. In a later filing, the appellants informed the Tribunal della pianificazione del territorio that their complaints had in substance been resolved by a subsequent zoning plan amendment approved on 2004-06-08 and asked that the case be removed from the docket. The tribunal held that the proceedings were exhausted, struck the appeal out, and ordered that no court fees or costs be charged.

la risoluzione18 marzo 2003, n. 1181, con cui il Consiglio di Stato ha approvato il piano regolatore del già comune di Fusio;
preso atto che, con scritto 31 agosto 2005, i ricorrenti hanno comunicato a questo tribunale che le censure avanzate con il summenzionato ricorso "sono in sostanza state evase con la modifica del piano regolatore, relativa ad alcuni comparti, approvata dal Consiglio di Stato con decisione no. 2397 dell'8 giugno 2004" e che il ricorso possa essere stralciato dai ruoli;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
