Kanton Zürich, Handelsregisteramt des Kantons Zürich Kläger

gegen

A._____ AG in Liquidation, Beklagte

vertreten durch Konkursamt B._____

betreffend Organisationsmangel

Rechtsbegehren: (act. 1) "Infolge Mängeln in der gesetzlich zwingend vorgeschriebenen Organi- sation der Gesuchsgegnerin seien die erforderlichen Massnahmen zu ergreifen; dies unter Kosten- und Entschädigungsfolge."

Der Einzelrichter zieht in Erwägung: 1. Am 11. August 2011 ging die Klage ein (act. 1). In jenem Zeitpunkt fehlte der Beklagten eine Regelung betreffend Revisionsstelle (act. 2/1). Am 31. August 2011 fallierte die Beklagte. Das Konkursverfahren wurde am 1. Dezember 2011 mangels Aktiven eingestellt und die Beklagte am 15. März 2012 gelöscht. Somit kann das vorliegende Verfahren zufolge Gegenstandslosigkeit abgeschrieben werden (Art. 242 ZPO). 2. Die Nebenfolgenregelung erübrigt sich. Der Streitwert beträgt – wie schon früher mitgeteilt – mindestens CHF 30'000.00. Der Einzelrichter verfügt: 1. Das Verfahren wird zufolge Gegenstandslosigkeit abgeschrieben. 2. Die Kosten fallen ausser Ansatz. 3. Es wird keine Entschädigung zugesprochen. 4. Schriftliche Mitteilung an die Parteien. 5. Eine bundesrechtliche Beschwerde gegen diesen Entscheid ist innerhalb von 30 Tagen von der Zustellung an beim Schweizerischen Bundesgericht, 1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde richten sich nach Art. 72 ff. (Beschwerde in Zivilsachen) oder Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 und
