The Obergericht held that although decisions on parent-child contact are generally non-pecuniary and appealable, a challenge directed only at the cost consequences, including legal aid, must be brought by complaint. In line with its constant practice, the court treated the misnamed remedy under the correct procedural title and rules.

Consistently mislabelled remedies are to be treated ex officio under the correct designation and according to the proper procedural provisions (consid. 2.2).

Konversion des Rechtsmittels. Art. 308 ZPO, Art. 319 ZPO; Behandlung einer als Berufung eingereichten Kostenbeschwerde

Erwägungen: (...) 2.2 Die Regelung der persönlichen Kontakte zwischen Eltern und Kindern ist nicht vermögensrechtlich, und ein Entscheid darüber ist daher kantonal mit Berufung anfechtbar (Art. 308 ZPO i.V.m § 187 GOG). Soll wie hier nur die Regelung der Kostenfolgen angefochten werden, wozu auch die Frage der unentgeltlichen Rechtspflege gehört, ist das zu ergreifende Rechtsmittel aber die Beschwerde (Art. 110 und 121 ZPO). Die Kammer verfolgt in Übereinstimmung mit der I. Zivilkammer die mittlerweile konstante Praxis, dass unrichtig bezeichnete Rechtsmittel ohne Weiteres mit dem richtigen Namen bezeichnet und nach den richtigen Regeln behandelt werden (OGer ZH PF110004 vom 9. März 2011, E. 5.2 am Ende zu finden via www.gerichte-zh.c h / Entschei de). D as vorliegende Rechtsmittel ist demnach als Beschwerde zu behandeln. (...)
