The Zurich Cantonal Court of Appeal held that the appellant's fax submissions of 11 and 14 November 2014 were defective and, because the defects were not cured, legally deemed never filed under Art. 132(1) CPC. As no valid appeal remained pending, the court held that it was not required to issue a non-entry decision; instead, the proceedings had to be struck off. It further decided, for equitable reasons, not to charge court costs.

Fehlt es damit an einem gültig anhängig gemachten Rechtsmittel, ist nicht auf ein Nichteintreten zu erkennen, sondern das Verfahren als gegenstandslos abzuschreiben. Die Abschreibung ist das zutreffende prozessuale Vorgehen, wenn die Eingabe rechtlich als nie erfolgt zu behandeln ist (vgl. Erwägung 3). Gerichtskosten können ausnahmsweise erlassen werden, wenn die Umstände dies rechtfertigen.

Art. 132 Abs. 1 ZPO, Mangelhafte und nicht verbesserte Eingabe. Das Verfahren wird abgeschrieben.

(aus einem Entscheid des Obergerichts:) Die Faxeingaben des Beschwerdeführers vom 11. und 14. November 2014 gelten demnach als ni cht erfolgt. Ist keine Beschwerde vorhanden, so fehlt es an einem zu behandelnden Rechtsmittel, weshalb kein Nichteintretensentscheid zu ergehen hat, sondern das Verfahren (androhungsgemäss) ohne weiteres abzuschreiben ist (...). 3. Umständehalber ist auf die Erhebung von Gerichtskosten zu verzi chten. Es wird beschlossen:

  1. Das Verfahren wird abgeschrieben. 2. Es werden keine Gerichtskosten erhoben.
