The applicant contested the condominium owners’ resolution of 30 April 2003 under agenda item 9, which changed the water allocation key. Aachen Local Court declared that resolution invalid, while rejecting the applicant’s remaining requests. It allocated two-thirds of the court costs to the applicant and one-third to the property manager. The property manager was also ordered to bear one-third of all participants’ extrajudicial costs; otherwise, each participant bears their own extrajudicial expenses.

Tenor

Der in der Eigentümerversammlung vom 30.04.03 unter TOP 9 gefasste Beschluss zur Änderung des Wasserverteilungsschlüssels wird für ungültig erklärt.

Im übrigen werden die Anträge zurückgewiesen.

Von den Gerichtskosten des Verfahrens tragen die Antragstellerin 2/3 und die weitere Beteiligte Verwalterin 1/3. Von den außergerichtlichen Kosten sämtlicher Beteiligter trägt die weitere Beteiligte Verwalterin 1/3. Im übrigen trägt jeder Beteiligte seine außergerichtlichen Kosten selbst.

Geschäftswert: 4.818,57 Euro.
