In a first-instance civil judgment, Aachen District Court ordered the defendant to pay the plaintiff €400, with interest at five percentage points above the base rate from 31 October 2002. Tenor

Der Beklagte wird verurteilt, an den Kläger 400 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 31. 10. 2002 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits haben der Kläger ¾ und der Beklagte ¼ zu tragen.

Das Urteil ist vorläufig vollstreckbar. Den Parteien wird gestattet, die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 110 % des aus dem Urteil vollstreckbaren Betrages abzuwenden, wenn nicht die Gegenpartei zuvor in gleicher Höhe Sicherheit leistet.
