In this first-instance civil action, the plaintiff sought setbacks for plants situated on the defendants’ property. The Aachen District Court ordered the defendants, jointly and severally, to move four specified plants to minimum distances of 4 m, 2 m, 1 m, and 2 m from the boundary, respectively. It dismissed the rest of the plaintiff’s claim and dismissed the counterclaim. Die Beklagten werden als Gesamtschuldner verurteilt, folgende auf ihrem Grundstück X-Straße ?? , befindliche Pflanzen zurückzusetzen:
die kanadische Hemlocktanne (Tsuga canandensis) auf einen Abstand von minde-stens 4 Metern zur Grundstücksgrenze; die Scheinzypresse (Chamaecyparis lawso-niana) auf einen Abstand von mindestens 2 Metern zur Grundstücksgrenze; die Stech-palme (Ilex aquifolium) auf einen Abstand von mindestens 1 Meter zur Grundstücks-grenze sowie den abendlichen Lebensbaum (Thuja occidentalis) auf einen Abstand von mindestens 2 Metern zur Grundstücksgrenze.
Im übrigen wird die Klage abgewiesen.
Die Widerklage wird abgewiesen.
Von den Kosten des Rechtsstreits haben die Klägerin 4/5 und die Beklagten als Ge-samtschuldner 1/5 zu tragen. Dies gilt nicht für die notwendigen Auslagen des Wider-beklagten zu 2), welche die Beklagten als Gesamtschuldner zu tragen haben.
Das Urteil ist vorläufig vollstreckbar. Die Beklagten können die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 1.500 € und die Klägerin gegen Sicherheitslei-stung in Höhe von 110% des aus dem Urteil vollstreckbaren Betrages abwenden, so-fern nicht die jeweilige Gegenpartei in gleicher Höhe Sicherheit leistet.

The defendants must set back the Canadian hemlock to at least 4 m, the false cypress to at least 2 m, the holly to at least 1 m, and the western arborvitae to at least 2 m from the boundary; the remainder of the claim is dismissed.

Allocation of the costs of the proceedings, including the necessary expenses of the second counter-defendant.
