Tenor

Der Beklagte wird verurteilt, an den Kläger 170,90 € zuzüglich Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basissatz seit dem 30.4.2003 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits haben der Kläger 1/5 und der Beklagte 4/5 zu tragen.

Das Urteil ist vorläufig vollstreckbar.
