The Local Court of Aachen partly granted the plaintiff’s civil claim against the defendants. The defendants were ordered jointly and severally to pay €462.50 with interest at five percentage points from 10 May 2004, and to release the plaintiff from liability for €98.02 in expert costs owed to T under an invoice dated 15 April 2004. The remainder of the claim was dismissed. Die Beklagten werden als Gesamtschuldner verurteilt, an die Klägerin 462,50 Euro nebst 5 Prozentpunkte Zinsen seit dem 10.05.2004 zu zahlen und die Klägerin hinsichtlich der Sachverständigenkosten in Höhe eines Betrages von 98,02 Euro gegenüber dem Anspruch des Sachverständigen T, O-K-Straße 3b in ####1 K (Rechnung vom 15.04.2004) freizustellen. Im Übrigen wird die Klage abgewiesen.
Von den Kosten des Rechtsstreits hat die Klägerin 50% und die Beklagten als Gesamtschuldner 50% zu tragen.
Das Urteil ist vorläufig vollstreckbar.
