Tenor

  1. Die Beklagte wird verurteilt, an den Kläger 460,00 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 21.08.2004 zu zahlen. Im Übrigen wird die Klage abgewiesen.

  2. Von den Kosten des Rechtsstreits hat der Kläger 36 % und die Beklagte 64 % zu tragen.

  3. Das Urteil ist vorläufig vollstreckbar.
