Die Beklagte wird verurteilt, an den Kläger 865,84 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 15. 12. 2004 zu zahlen.
Die Kosten des Rechtsstreits hat die Beklagte zu tragen.
Das Urteil ist vorläufig vollstreckbar. Die Beklagte kann die Vollstreckung gegen Sicherheitsleistung in Höhe von 110 % des aus dem Urteil vollstreck-baren Betrages abwenden, sofern nicht der Kläger in gleicher Höhe Sicher-heit leistet.
