Tenor

Der Beklagte wird verurteilt, an die Klägerin 239,26 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszins-satz aus 565,94 € seit dem 13.10.2006 bis zum 26.01.2007, sowie aus 239,26 € seit dem 26.01.2007 zu zahlen.

Zudem wird der Beklagte verurteilt, an die Klägerin vorge-richtliche Anwaltsgebühren in Höhe von 47,50 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 21.11.2006 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits trägt die Klägerin 7 % und der Beklagte 93 %.

Das Urteil ist vorläufig vollstreckbar.
