Tenor

I.

Die Beklagte wird verurteilt, die Klägerin von einer Restforderung der Firma B GmbH & Co. KG, S25 in ####1 B, gemäß Rechnung 76569 5000 vom 02.08.2005 in Höhe von 625,00 € freizustellen.

II.

Die Beklagte wird weiter verurteilt, an die Klägerin außergerichtlich ent-standen Rechtsanwaltsgebühren in Höhe von 120,67 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit 16.07.2007 zu bezahlen.

III.

Im übrigen wird die Klage abgewiesen.

IV.

Von den Kosten des Rechtsstreits trägt die Klägerin 1/5, die Beklagte 4/5.

V.

Dieses Urteil ist vorläufig vollstreckbar.

Die Parteien können jedoch die Vollstreckung gegen sich durch Sicher-heitsleistung in Höhe von 110 % des aufgrund dieses Urteils gegen sie vollstreckbaren Betrages abwenden, wenn nicht die jeweils vollstrecken-de Partei vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.

Streitwert: 787,80 €.
