The Aachen District Court, deciding under the simplified procedure without an oral hearing, declared that the plaintiff’s telecommunications relationship with the defendant, under customer number K 4971 and the tariff arrangement formed on 20 February 2007, ended on 31 March 2009 following the plaintiff’s notice. It ordered the defendant to release the telephone and internet connection and to cooperate with the new provider’s commencement of service. The defendant was also ordered to hold the plaintiff harmless for EUR 83.54 in pre-litigation attorney costs and to bear the costs of the proceedings. Es wird festgestellt, dass das Telekommunikationsverhältnis zwischen den Parteien unter der Kundennummer K 4971 in der Form des Tarifwechsels vom 20.02.07 durch die Kündigung der Klägerin vom 21.02.09 zum 31.03.09 beendet worden ist.
Die Beklagte wird verurteilt, den Telefon- und Internetanschluss der Klägerin freizugeben und gegenüber dem nachfolgenden Anbieter alle Informationen, Erklärungen und Mitwirkungshandlungen vorzunehmen, die zur Aufnahme der Versorgung durch den neuen Anbieter erforderlich sind sowie die Klägerin von vorgerichtlichen Anwaltskosten von 83,54 Euro freizustellen.
Die Kosten des Rechtsstreits werden der Beklagten auferlegt.
Das Urteil ist vorläufig vollstreckbar.
