Tenor

In dem Rechtsstreit

hat das Amtsgericht Aachen

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 16.08.2010

durch den Richter am Amtsgericht Foerst

für Recht erkannt:

Die Beklagte wird unter Klageabweisung im Übrigen verurteilt, an die Klägerin 149,60 Euro und vorgerichtliche Rechtsanwaltskosten von 39,- Euro jeweils nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 29.10.09 zu zahlen.

Die Kosten des Rechtsstreits werden der Klägerin zu 60 % und der Beklagten zu 40 % auferlegt.

Das Urteil ist vorläufig vollstreckbar.
