Tenor
Auf die Klage wird die Beklagte verurteilt, die Klägerin von den außergerichtlichen Kosten der anwaltlichen Vertretung in Höhe von 215,00 € freizustellen.
Im Übrigen wird die Klage abgewiesen.
Auf die Widerklage wird festgestellt, dass der Klägerin über die Klageforderung i.H.v. 1640,21 € hinaus kein weiterer Anspruch auf Zahlung von Mietwagenkosten zusteht.
Die Kosten des Rechtsstreits werden der Klägerin zu 56 % und der Beklagten zu 44 % auferlegt.
Das Urteil ist vorläufig vollstreckbar. Die jeweilige Vollstreckungsschuldnerin darf die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des aus dem Urteil vollstreckbaren Betrages abwenden, wenn nicht die jeweilige Gläubigerin vor der Vollstreckung Sicherheit geleistet hat in Höhe von 110 % des jeweils vollstreckbaren Betrages.
