I. Unter Abweisung der weitergehenden Klage wird die Beklagte verurteilt, an den Kläger 423,68 Euro nebst Zinsen in Höhe von 5 %Punkten über dem Basiszinssatz seit dem 19.09.2001 zu zahlen.

II. Von den Kosten des Rechtsstreits trägt der Kläger 46%, der Beklagte trägt 54%.

III. Das Urteil ist vorläufig vollstreckbar.
