The debtor filed an objection on 9 October 2017 concerning the creditor’s request to supplement or repeat an asset disclosure made on 17 March 2017. The Ahaus Local Court directed the senior enforcement officer identified as K not to comply with the request and to discontinue further enforcement in that respect. The creditor was ordered to bear the court’s expenses and the out-of-court costs; no court fees are payable. The value of the proceedings was fixed at EUR 5,000.

Tenor

wird der Obergerichtsvollzieher K auf die Erinnerung des Schuldners vom 09.10.2017 hin angewiesen, dem Antrag der Gläubigerin vom 07.09./17.11.2017 auf Nachbesserung/erneute Abgabe der Vermögensauskunft vom 17.03.2017 nicht nachzukommen und die weitere Zwangsvollstreckung insoweit einzustellen.

Gerichtskosten fallen nicht an. Die Auslagen des Gerichts und die außergerichtlichen Kosten trägt die Gläubigerin.

Der Verfahrenswert wird auf 5.000 Euro festgesetzt.
