Tenor

Der Beklagte wird verurteilt, an die Klägerin 2.364,90 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz aus 2.097,32 EUR seit dem 05.12.2001 zu zahlen.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 110% des zu vollstreckenden Betrages.

Der Antrag des Beklagten vom 09.10.2003 auf Bewilligung von Prozesskostenhilfe wird zurückgewiesen.
