In this final judgment, the Bielefeld District Court supplemented an earlier partial acknowledgment judgment ordering the defendant to pay €386.70. It ordered interest at 9.89% on that sum from 3 February 2013 and required the defendant to release the plaintiff from liability for €83.54 in attorney fees. The court dismissed the remainder of the claim and allocated two-thirds of the costs to the plaintiff and one-third to the defendant. The judgment was declared provisionally enforceable, subject to security provisions.

Tenor

Die Beklagte wird über die im Teilanerkenntnisurteil des Amtsgerichts Bielefeld vom 11. September 2013 ausgeurteilten 386,70 € hinaus verurteilt, auf diese Summe Zinsen i.H.v. 9,89 % seit dem 03.02.2013 zu zahlen.

Die Beklagte wird weiter verurteilt, die Klägerin von Rechtsanwaltskosten der Rechtsanwälte S. aus C. i.H.v. 83,54 € freizustellen.

Die weitergehende Klage wird abgewiesen.

Die Kosten des Rechtsstreites tragen die Klägerin zu 2/3 und die Beklagte zu 1/3.

Das Urteil ist vorläufig vollstreckbar.

Den Parteien bleibt nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung i.H.v. 110 % des jeweils beizutreibenden Betrages abzuwenden, wenn nicht die jeweils andere Seite vor der Vollstreckung Sicherheit in gleicher Höhe leistet
