Tenor

  1. Die Beschlüsse der Eigentümergemeinschaft zu TOP 3 und 4 werden für ungültig erklärt.

  2. Die Eigentümergemeinschaft wird verpflichtet, den Verwalter anzuweisen, die Heizkosten der Jahre 2006 und 2007 nach der Wohnfläche oder dem umbauten Raum der beheizten Räume neu abzurechnen.

  3. Im Übrigen wird die Klage abgewiesen.

  4. Die Kosten des Rechtsstreits werden gegeneinander aufgehoben.

  5. Das Urteil ist vorläufig vollstreckbar. Die Parteien dürfen die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leisten.
