The plaintiff brought a claim in a tenancy dispute concerning security exceeding the limit in § 551(1) BGB. The Kerpen Local Court dismissed the claim and ordered the plaintiff to bear the costs. It held that excess security is invalid even if the security provider offered it and the tenant does not appear to be burdened by it. The judgment is provisionally enforceable and permits the plaintiff to avert enforcement by providing security of 110% of the enforceable amount, unless the defendants provide security of 110% of the amount to be enforced.

Security furnished beyond the limit prescribed by § 551 Abs. 1 BGB is invalid even where it was offered by the security provider and does not appear to impose a burden on the tenant. The statutory protection is not made dependent on whether the tenant was demonstrably pressured or otherwise disadvantaged in the individual case. This position is contrary to BGHZ 111, 361 ff.

Die Gestellung eier Sicherheit über § 551 Abs. 1 BGB hinausgehend ist auch dann nichtig, wenn diese vom Sicherungsgeber angeboten wurde und der Mieter durch sie nicht erkennbar belastet wird (gegen BGHZ 111, 361 ff. = ZMR 1990, 327).
Die Klage wird abgewiesen.
Die Kosten des Rechtsstreits werden dem Kläger auferlegt.
Das Urteil ist vorläufig vollstreckbar.
Dem Kläger bleibt nachgelassen, die Zwangsvollstreckung durch die Beklagten gegen Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages abzuwenden, wenn nicht die Beklagten vor der Vollstreckung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages leisten.
