The applicants challenged a condominium owners' meeting resolution of 9 December 1999 concerning conservatory renovation. Bonn Local Court declared the resolution void insofar as the community had resolved to remedy damage to separate property, rejecting the application in all other respects. The applicants were ordered to bear the court costs, and no out-of-court costs were reimbursed. The value in dispute was fixed at DM 26,500 through 6 July and DM 25,000 from 7 July.

Tenor

Der Beschluss der Wohnungseigentümerversammlung vom 09.12.1999 zu TOP 3 (Sanierung der Wintergärten) wird für nichtig erklärt, soweit die Gemeinschaft beschlossen hat Schäden am Sondereigentum zu beseitigen.

Im übrigen wird der Antrag abgewiesen.

Die Antragsteller tragen die Gerichtskosten;

außergerichtliche Kosten werden nicht erstattet.

Der Geschäftswert wird wie folgt festgesetzt:

Bis zum 6.7. auf 26.500,00 DM (TOP 3.1: 25.000,00 DM; TOP 5: 1.500,00 DM), seit dem 7.7. auf 25.000,00 DM.
