In this first-instance civil judgment, the Bonn Local Court partially granted the plaintiff’s payment claim. It ordered the defendant to pay EUR 2,460.05, equivalent to DM 4,811.46, together with interest at 5% above the applicable base rate from 22 December 2000. The remainder of the claim was dismissed. Litigation costs were divided one fifth to the plaintiff and four fifths to the defendant. The judgment was declared provisionally enforceable against security of EUR 3,500.

Tenor

Unter Abweisung der Klage im übrigen wird die Beklagte verurteilt, an den Kläger 4.811,46 DM = 2.460,05 EUR nebst 5 % Zinsen über dem jeweiligen Basiszinssatz nach § 1 DÜG seit dem 22.12.2000 zu zahlen.

Die Kosten des Rechtsstreits tragen zu 1/5 der Kläger und zu 4/5 die Beklagte.

Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 3.500,-- EUR.
