Die Klage wird abgewiesen.

Die Kosten des Rechtsstreits werden dem Kläger auferlegt.

Dem Kläger wird gestattet, die Vollstreckung des Beklagten wegen der Kosten durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abzuwenden, wenn nicht zuvor der Beklagte Sicherheit in gleicher Höhe leistet.
