Tenor

  1. Die Beklagte wird verurteilt an die Klägerin 595,78 Euro nebst 8 Prozentpunkten über dem Basiszinssatz aus 30,21 Euro seit dem 14.05.2007 und aus 565,57 Euro seit dem 20.05.2007 zu zahlen. Im übrigen wird die Klage abgewiesen.

  2. Die Kosten des Rechtsstreites tragen die Klägerin zu 42 % und die Beklagte zu 58 %.

  3. Das Urteil ist vorläufig vollstreckbar für die Klägerin gegen Sicherheitsleistung in Höhe von 120 % des beizutreibenden Betrages. Für die Beklagte ist das Urteil ohne Sicherheitsleistung vorläufig vollstreckbar. Die Klägerin kann die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des beizutreibenden Betrages abwenden, sofern nicht die Beklagte Sicherheit in gleicher Höhe vor der Vollstreckung leistet.
