Resumo Omnilex

The plaintiff brought a civil claim concerning the terms of a capital life insurance policy, alleging inadequate transparency and seeking information about the amount of the unzillmerized actuarial reserve. The Bonn Local Court dismissed the action. It found the terms sufficiently transparent because they explained the economic disadvantage caused by charging all acquisition costs at the beginning of the policy and included a table of surrender values at the expected place for that information. It consequently found no basis for a separate information claim regarding the unzillmerized reserve. The plaintiff was ordered to bear the costs.

Sumário Omnilex

BGB §§ 305, 307 Abs. 1; transparency of capital life insurance terms where acquisition costs are charged upfront. Terms are not intransparent merely because all acquisition costs are charged to the policy account at inception, if they inform the policyholder of the resulting economic disadvantage and provide a table of surrender values at the place where a consumer would expect that information. In those circumstances, an additional claim for disclosure of the amount of the unzillmerized actuarial reserve does not arise.

The terms were not intransparent because they disclosed the economic disadvantage and presented a table of surrender values where consumers would expect the information.

The disclosure of the initial charging of acquisition costs, together with the surrender-value table, sufficiently informed policyholders about the resulting economic consequences.

No information claim concerning the amount of the unzillmerized reserve was available.

The terms were not intransparent, and the requested disclosure claim therefore did not arise.
