Resumo Omnilex

The Bonn Local Court set aside its default judgment of 27 August 2012 and ordered the defendant to restore the plaintiff’s EUR 1,400 rental deposit to the deposit account and invest it insolvency-proof. The court held that a standard-terms provision permitting the landlord to use the deposit during the tenancy for alleged claims against the tenant unfairly disadvantages the tenant and is invalid. The plaintiff was ordered to bear one quarter of the litigation costs and the defendant three quarters, except for costs caused by the defendant’s failure to appear, which he must bear himself.

Sumário Omnilex

BGB §§ 551(3), 307(2); landlord’s access to a rental deposit during an ongoing tenancy. A standard-terms agreement authorizing a landlord to access the tenant’s security deposit during the tenancy to satisfy alleged claims against the tenant unreasonably disadvantages the tenant and is invalid. The deposit serves as security for claims arising from the tenancy, but the landlord may not unilaterally use it during the ongoing tenancy to satisfy disputed or purported claims. The deposit must remain separately protected and, in particular, insolvency-proof invested; a clause permitting premature access conflicts with the statutory protection of the tenant’s security.
