Resumo Omnilex

The plaintiff insurer sought recourse from the defendant insured on the basis that the insured left an accident scene before the accident was recorded. The court held that a breach of the insured’s obligations—and thus a basis for recourse—could be absent where the insured had spoken with the other accident participant in the presence of witnesses and there had been an opportunity to note the insured vehicle’s registration number. The court set aside its default judgment of 15 November 2012, dismissed the claim, and ordered the plaintiff to bear the costs.

Sumário Omnilex

VVG Art. 28 paras. 2 and 3; departure from an accident scene before official recording does not, by itself, establish an insurance-policy obligation breach justifying recourse against the insured. The assessment depends on whether the departure frustrated the insurer’s legitimate interest in clarifying the accident and investigating its circumstances. Where the insured had previously spoken with the other participant in the presence of witnesses and the vehicle registration number could have been recorded, the relevant investigative interests may remain sufficiently protected; an obligation breach may therefore be excluded. The criminal-law duty associated with leaving an accident scene under StGB Art. 142 does not automatically determine the insurance-law question. (VVG Art. 117 para. 5.)
