The plaintiff brought a civil claim arising from a collision between a bus and a car. Kollidiert ein Bus, der auf einer vorfahrtberechtigten Straße verkehrt und verkehrswidrig die Linksabbiegerspur der Gegenfahrbahn zum Überholen nutzt, mit einem PKW, der aus einer untergeordneten Straße nach links auf die vom Bus genutzte Straße abbiegt und hierbei in der freien Sicht auf die vorfahrtberechtigte Straße durch andere Verkehrsteilnehmer beeinträchtigt ist, rechtfertigt dies eine Haftungsverteilung von 2/3 zu 1/3.
Die Beklagten werden verurteilt, an die Klägerin gesamtschuldnerisch 320,92 €, gesamtschuldnerisch Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz aus 320,92 € seit dem 03.05.2013, die Beklagte zu 2) darüber hinaus weitere Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz aus 320,92 € vom 11.01.2013 bis zum 02.05.2013 sowie gesamtschuldnerisch 192,90 € außergerichtlicher Rechtsverfolgungskosten zu zahlen.
Darüber hinaus wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt die Klägerin.
Das Urteil ist vorläufig vollstreckbar. Der jeweilige Vollstreckungsschuldner kann die Zwangsvollstreckung aus diesem Urteil durch Sicherheitsleistung in Höhe von 110 % des aufgrund des Urteils zu vollstreckenden Betrages abwenden, wenn nicht der der Vollstreckungsgläubiger zuvor Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
