Resumo Omnilex

The Bonn Local Court dismissed the plaintiff's claim and ordered her to bear the costs of the proceedings. It held that entering a TAN generated during online banking without first checking the recipient account number, transfer amount, and start code constitutes a grossly negligent breach of care. The judgment is provisionally enforceable, subject to the stated security provisions.

Sumário Omnilex

BGB § 675v Abs. 2 sentence 2; gross negligence in online banking. A user who enters a TAN generated during an online-banking process without first comparing the recipient account number, transfer amount, and start code fails to exercise the required care to a grossly negligent degree. Verification of these transaction details before TAN entry is a necessary safeguard against authorizing a transfer whose terms do not match the user's intention.
