The plaintiff brought a civil claim arising from a traffic accident. Entstehen aus einem Verkehrsunfall für den Geschädigten mehrere Forderungen, so kann von der Gesamtsumme der Forderungen nicht ein nur summenmäßig bestimmter Teil abgetreten werden.
Die Klage wird abgewiesen.
Die Kosten des Rechtsstreits trägt die Klägerin.
Das Urteil ist vorläufig vollstreckbar. Die Klägerin kann die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 120 % des auf Grund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die Beklagte vor der Zwangsvollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
Die Berufung wird zugelassen.
