In this first-instance civil judgment, the Bonn Local Court appointed C, acting through Hausverwaltung C e.Kfm., as administrator of the apartment owners’ association Dstraße, B, until 15 August 2019, on the terms of the attached administration agreement. The court dismissed the remainder of the claim. It ordered the costs of the proceedings to be offset between the parties. The judgment is provisionally enforceable as to costs, subject to security of 110% of the amount to be enforced.

Tenor

Herr C handelnd unter Hausverwaltung C e.Kfm., Sstraße, C wird auf der Grundlage des diesem Urteil als Anlage beigefügten Verwaltervertrages bis zum 15.08.2019 zum WEG – Verwalter der Wohnungseigentümergemeinschaft Dstraße , B, bestellt.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden gegeneinander aufgehoben.

Das Urteil ist hinsichtlich der Kosten vorläufig vollstreckbar. Den Parteien wird nachgelassen, die gegen sie gerichtete Vollstreckung durch Sicherheitsleistung i. H. v. 110 % des jeweils zu vollstreckenden Betrages abzuwenden, wenn nicht die andere Partei vor Vollstreckung Sicherheit in gleicher Höhe leistet.
