The plaintiff challenged the owners’ meeting resolution of 13 September 2018 under TOP 13 and sought permission to conduct a childminding business in her apartment, including its terrace. Tenor

Der Beschluss der Eigentümerversammlung vom 13.09.2018 unter TOP 13 wird für ungültig erklärt.

Die Genehmigung der Ausübung eines selbständigen Gewerbes als Tagesmutter in der Wohnung der Klägerin einschließlich Terrasse Am C ‚##, ##### C , Erdgeschoss rechts/Mitte im Aufteilungsplan mit Nr. ### bezeichnet wird für maximal drei Tageskinder unter drei Jahren im Zeitraum von Montag bis Freitag von 08:30 Uhr bis 15:00 Uhr erteilt.

Die Kosten des Rechtsstreits tragen die Beklagten.

Das Urteil ist hinsichtlich der Kosten gegen Sicherheitsleistung in Höhe von 110% des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.
