In a first-instance civil action, Bochum District Court ordered the defendants jointly and severally to pay the plaintiff EUR 3,172.78, equivalent to 6,205.42 DM, plus interest at 5% above the applicable base rate from 22 February 2002. The court dismissed the remainder of the claim and allocated two thirds of the proceedings’ costs to the defendants and one third to the plaintiff. The judgment was declared provisionally enforceable subject to security conditions.

Tenor

  1. Die Beklagten werden als Gesamtschuldner verurteilt an die Klägerin 6.205,42 DM (= 3.172,78 Euro) nebst 5 % Zinsen über dem jeweiligen Basiszinssatz ge-mäß DÜL seit dem 22.02.2002 zu zahlen.

Im übrigen wird die Klage abgewiesen.

  1. Die Kosten des Rechtsstreits tragen die Beklagten zu 2/3 und die Klägerin zu 1/3.

  2. Das Urteil ist vorläufig vollstreckbar, für die Klägerin jedoch nur gegen Sicher-heitsleistung in Höhe von 6.100,00 Euro.

Die Klägerin kann die Vollstreckung durch die Beklagten durch Sicherheitslei-stung in Höhe von 1.000,00 Euro abwenden, wenn diese nicht zuvor Sicherheit in gleicher Höhe leisten.

  1. Der Streitwert wird auf 4.825,64 Euro (= 9.438,13 DM) festgesetzt.
