Resumo Omnilex

The applicant sought review of the registrar’s 7 January 2008 refusal of legal advice assistance. The Bochum Local Court held the objection admissible but unfounded and dismissed it. It relied on its earlier decisions that the possibility of obtaining information from an administrative authority does not ordinarily amount to the absence of another advice option, except in substantiated exceptional cases. The same consideration applies when assessing whether seeking immediate lawyer assistance is unreasonable. Despite a request from the registrar, the applicant’s representative had provided no relevant explanation. The court therefore found no basis to apply an exceptional case. Extrajudicial expenses were not reimbursed.

Sumário Omnilex

§ 1 Abs. 1 Nr. 2 und Nr. 3 BerHG; availability of administrative information and immediate legal advice assistance: The possibility of obtaining information from an authority is generally another means of advice and precludes legal advice assistance on that ground. An exception requires circumstances that are specifically substantiated as exceptional. The same approach applies when determining whether it is unreasonable to seek legal advice assistance directly from a lawyer. A party’s failure to provide requested explanations supporting an alleged exception prevents the court from finding that the exceptional conditions are met.

Tenor

The objection was admissible but unfounded; no exceptional circumstances establishing the need for immediate lawyer assistance were substantiated.

The applicant’s representative did not provide the requested information despite the registrar’s invitation. A possibility of obtaining information from an authority is generally an alternative to legal advice assistance, except in substantiated exceptional cases; the same principle applies to whether seeking immediate assistance is unreasonable.
