In this first-instance tenancy judgment, the Bochum Local Court partially set aside its default judgment of 6 May 2010. It ordered the defendant to pay the plaintiff EUR 3,479.86, with interest on EUR 1,514.20 from 11 January 2008 and on EUR 1,965.66 from 27 May 2008, plus a further EUR 359.50 with interest from 27 May 2008. The remainder of the claim was dismissed, with the default judgment maintained to that extent. The defendant was charged with 72% of the litigation costs and the plaintiff with 28%.

Tenor

Unter teilweiser Aufhebung des Versäumnisurteils des erkennenden Gerichtes vom 06.05.2010 wird der Beklagte verurteilt, an die Klägerin 3.479,86 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz der Europäischen Zentralbank aus einem Betrage von 1.514,20 EUR seit dem 11.01.2008 und aus einem weiteren Betrage in Höhe von 1.965,66 EUR seit dem 27.05.2008 sowie weitere 359,50 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz der Europäischen Zentralbank seit dem 27.05.2008 zu zahlen.

Im übrigen wird die Klage abgewiesen und bleibt das Versäumnisurteil des erkennenden Gerichtes vom 06.05.2010 aufrechterhalten.

Die Kosten des Rechtsstreits trägt der Beklagte zu 72 % und die Klägerin zu 28 %.

Das Urteil ist vorläufig vollstreckbar.

Für die Klägerin jedoch nur gegen Sicherheitsleistung in Höhe von 5.000,00 EUR.
